General Provisions

  1. These Terms of Use (hereinafter referred to as the “Terms”) govern the relationship between you (hereinafter referred to as the “User”) and the OpenQuiz web service, available at the domain oquiz.net (hereinafter referred to as the “Service”).
  2. By using the Service, you confirm your full and unconditional agreement with these Terms.
  3. If you do not agree with the Terms, please refrain from using the Service.

Registration and Account

  1. To fully use the Service, you must register by providing the following information:
    • a valid email address;
    • a unique nickname;
    • a profile image (optional).
  2. You are fully responsible for the accuracy of the information provided and for maintaining the confidentiality of your password and account access.
  3. You agree not to transfer access to your account to third parties and to immediately notify the Service administration of any suspicion of unauthorized use.

Service Usage

  1. The Service is an online platform for creating and taking quizzes.
  2. When using the Service, you agree to:
    • act in accordance with the purpose of the Service and these Terms;
    • not publish content that violates legislation, moral standards, or the rights and interests of third parties;
    • not attempt to hack, destabilize, or otherwise interfere with the functioning of the Service.
  3. We reserve the right to suspend or delete your account in case of violation of these Terms without prior notice.

Intellectual Property

  1. User Content and Rights to It** All materials that you create and upload to the Service, including texts, questions, images, and other elements (hereinafter referred to as “Content”), are your intellectual property.
  2. License Granted to the Service From the moment you upload Content to the Service, you grant us a free, non-exclusive, worldwide, perpetual license with the right to sublicense to use your Content. This license includes the right to:
    • reproduce, distribute, publicly display, and make your Content publicly available within the framework of the Service’s operation;
    • adapt, modify, and translate Content to ensure its technical compatibility with the Service;
    • use Content in advertising and marketing materials aimed at promoting the Service.
  3. Preservation of Non-Property (Moral) Rights You retain all non-property (moral) rights to your content, including:
    • right of authorship — the right to be recognized as the author of the content;
    • right to name (pseudonym) — the right to require the indication of your name or pseudonym when using the content;
    • right to the integrity of the work — the right to object to any distortions or actions that may damage your honor, dignity, or business reputation;
  4. Service Content All rights to the Service itself, including its design, program code, logos, and content created by the administration, belong to OpenQuiz.

Limitation of Liability

  1. The Service is provided on an “as is” basis. We do not guarantee its uninterrupted operation, absence of errors, or full compliance with your expectations.
  2. We are not responsible for:
    • any failures, technical malfunctions, or temporary unavailability of the Service;
    • direct or indirect damage resulting from the use or inability to use the Service;
    • the content and legality of materials published by other users.
  3. We undertake to make all reasonable efforts to promptly resolve any technical problems that arise.

Termination of Use

  1. You have the right to stop using the Service at any time and delete your account through profile settings or by contacting support.
  2. After deleting your account, all associated progress, data, and results will be irretrievably lost.

Changes to the Terms

  1. We reserve the right to unilaterally change these Terms.
  2. The current version of the Terms is always available in the Service. We may additionally notify you of changes by email or through the Service interface.
  3. By continuing to use the Service after the changes take effect, you express your agreement with the new version of the Terms.

Applicable Law and Dispute Resolution

  1. All disputes and disagreements arising from these Terms will be resolved by the parties through negotiations. If an agreement cannot be reached, the dispute will be considered in court at the location of the Service operator.
